PART - I - RJIL PRIVACY POLICY
This RJIL Privacy Policy shall be read and
construed along with and in relation to the RJIL Internet Acceptable Use
Policy.
1. COLLECTION: RJIL may collect the
following two types of information:
- personal
information, which could reasonably be used to identify you personally, such as
your name, email address, registration account details, physical address or
other relevant personal details; and demographic information, such as gender,
pin code or similar information. For the purpose of this policy, sensitive
personal data or information has been considered as a part of personal
information, which may include information such as password, financial
information (details of bank account, credit card, debit card, or other payment
instrument details).
- Non-personal
information that does not identify you or any other individual, and includes
session and usage data, log data and aggregate information.
- RJIL
may install cookies or other similar data collection software in your computer
system for such purpose and you hereby consent to the same.
You represent that the information or data
you provide from time to time is and shall be correct, current and updated and
you have all the rights, permissions and consents to provide such information
or data. You're providing the information or data and RJIL consequent storage,
collection, usage, transfer, access or processing of the same shall not be in
violation of any third party agreement, laws, charter documents, judgments,
orders and decrees.
2. USE: The information so
provided by you to RJIL or captured by RJIL may be used for a number of
purposes connected with RJIL business operations which may include the
following:
- processing orders or applications provisioning of services,
- testing or improvement of services,
- recommending/advertising various products or services including those of third parties dealing with requests,
- enquiries and complaints and customer related activities,
- marketing products and services and its analysis,
- abiding with laws and law enforcement / regulatory requests
3. DISCLOSURE: RJIL does not sell or
rent personal information. Personal information may be disclosed under the
following circumstances as follows:
- RJIL
may disclose your personal information to its affiliates, group companies,
consultants, vendors and contractors under confidentiality restrictions
- RJIL
may disclose personal information with your consent to third parties.
- RJIL
may provide your information or data to its partners, associates, service
providers or other third parties to provide, advertise or market their
legitimate products and/or services which may be of your interest. You will
have the choice to 'opt out' of such marketing or promotional communications at
your will.
- Your
consent being part of the terms and conditions through which RJIL provide you
with a service. Your consent may be implicit or implied or through course of
conduct.
- as necessary or appropriate: (a) in any manner permitted under Applicable Law,
including laws outside your country of residence; (b) to comply with legal
process whether local or foreign; (c) to respond to requests from public and
government authorities, including public and government authorities outside
your country of residence; (d) to enforce our terms and conditions; (e) to
protect our rights, privacy, safety or property, and/or that of our affiliates,
you or others; and (f) to allow us to pursue available remedies or limit the
damages that we may sustain.
4. INFORMATION SECURITY
AND STORAGE: RJIL
uses reasonable security measures, at the minimum those mandated under
Information Technology Act, 2000 as amended and read with Information
Technology (Reasonable Security Practices and Procedures and Sensitive Personal
Data or Information) Rules, 2011, to safeguard and protect your data and
information. You accept the inherent security implications of providing
information over the internet and will not hold RJIL responsible for any breach
of security or the disclosure of personal information unless RJIL has been
grossly and wilfully negligent.
Your information or
data will primarily be stored in electronic form however certain data can also
be stored in physical form. RJIL may store, collect, process and use your data
in countries other than Republic of India but under full compliance with
applicable laws. RJIL may enter into agreement with third parties (in or
outside of India) to store your information or data. These third parties may
have their own security standards to safeguard your information or data and we
will on commercial reasonable basis require from such third parties to adopt
reasonable security standards to safeguard your information / data.
5. THIRD PARTY WEBSITES,
APPLICATIONS AND SERVICES: We may provide links to third-party web sites or
applications or services to you. This policy does not address, and we are not
responsible for, the privacy practices of web sites or applications or services
operated by third parties. The accessibility to third party web sites or
application or services does not imply endorsement of such third party web site
or application or services by RJIL.
6. ACCESS, CORRECTION
AND DELETION: RJIL
provides you with all information that we maintain about you such as the
transaction and contact information upon proper verification. This may be
provided to you on request, in case you experience any doubts. You may request
access and/or correct the information RJIL has collected from you by contacting
in writing to us at care@jio.com . If you wish to have the information or
data that you have provided to RJIL deleted, you can always do so by sending a
request to us on the e-mail id provided. You may note that correction or
deletion of certain information or data may lead to cancellation of your registration
with the services or your access to certain features of the services. You also
agree and acknowledge that certain data or information cannot be corrected or
deleted or prohibited to be deleted as required under any Applicable Law, law
enforcement requests or under any judicial proceedings.
7. TRANSFERRING PERSONAL
INFORMATION OVERSEAS: RJIL endeavors to take reasonable steps to limit the
amount of personal information it sends to organizations overseas. If such
information must be sent by RJIL overseas for relevant business reasons, RJIL
will reasonably require the overseas organization receiving the information to
provide a binding undertaking that it will handle such information in
accordance to the applicable laws.
PART - II - GENERAL TERMS APPLICABLE TO THE
POLICIES
- The
indemnification obligation, disclaimer of warranties, limitation of liability
and governing law shall indefinitely survive any expiry or early termination of
the Services, the App and/or the Policies.
- You
shall indemnify and hold RJIL, its affiliates, its third party network /
infrastructure provider and their respective directors, officers, personnel,
contractors and agents harmless for and against any and all claims (whether
third party or counter-party), suits, judgment, losses, damages, cost and
expenses arising or relating to your usage of the Services, the App and/or from
your breach of the terms of the Policies.
- NOTWITHSTANDING
ANYTHINIG CONTRARY CONTAINED HEREIN, IN ANY EVENT, RJIL SHALL NOT BE LIABLE FOR
ANY CONSEQUENTIAL, INCIDENTIAL, INDIRECT, SPECIAL, EXEMPLARY AND PUNITIVE
DAMAGES OR LOSSES INCLUDING LOSS OF OR DAMAGE TO DATA, LOSS OF GOODWILL, LOSS
BUSINESS, REVENUE AND PROFITS, EVEN IF RJIL HAS BEEN ADVISED OF SUCH DAMAGES OR
LOSSES AND THAT RJIL SHALL NOT BE HELD LIABLE FOR ANY CLAIMS, LOSSES, ACTIONS,
DAMAGES, SUITS OR PROCEEDINGS ARISING OUT OF OR OTHERWISE RELATING TO ANY
SERVICES , THE APP AND RJIL NETWORK AND TOTAL AGGREGAGE LIABILITY OF RJIL FOR
ALL CLAIMS UNDER THE POLICIES, RELATING TO THE SERVICES, THE APP AND RJIL
NETWORK (INCLUDING FOR BREACH OF CONTRACT, TORT OR NEGLIGENCE) SHALL IN NO
EVENT EXCEED INDIAN RUPEES ONE HUNDRED ONLY.
- The
Policies shall be governed by the laws of India without giving effect to
principles of conflict of laws and all disputes and differences hereunder shall
be subject to the sole and exclusive jurisdiction of the courts situated at
Mumbai, State of Maharashtra, Republic of India. The usage of Service and the
App is personal to you and you shall not assign or transfer this right to any
third person. The Policies contain the entire understanding and supersedes all
prior understandings between the parties relating to the subject matter herein
and the Policies cannot be changed except in a writing or changed by RJIL in
the manner as provided in these Policies. Any failure by us to enforce these
Policies, for whatever reason, shall not necessarily be construed as a waiver
of any right to do so at any time. If any portion of any of the Policies is
held invalid or unenforceable, that portion will be construed consistent with Applicable
Law as nearly as possible, and the remaining portions will remain in full force
and effect.
- All
the capitalized words used in the Policies shall have the meaning as defined in
the respective Policy and shall apply to all the Policies.

accordance with the Applicable Laws, for any grievance, including under the
Policies, you may reach the grievance officer of RJIL at care@jio.com .
